The court heard Stein, in the voicemails, told Kallista Mutten that if she didn't bring the vehicle back, “He's going to hurt you as much as everybody else, and I'm going to tell the police who you are took your daughter”.

Stein repeatedly demanded that she pick up the phone, sometimes raising her voice to the point of shouting. In a message left at 10.05am, the court heard he said: “Guess what? The other car just started, c—, and I've got my bloody guns, and now I'm going to kill the shit out of you.”

“You screwed me for the last time,” he said. “It was bullshit that you did that to Charlise for…I, no…I'll kill you.”

Stein said Kallista Mutten police were on their way and “you got off, dog.” He claimed he had vandalized several properties and it was his “last chance” to “do the right thing”.

Earlier, the jury heard the call from triple zero made by Charlise's mother at 8.12am on January 14, in which she said: “I'm sorry, I have to report my daughter missing… she has nine years.” He said he last saw her “two nights ago.”

“She was here [at Wildenstein]I wasn't here, my partner was here,” Kallista Mutten said.

“During the morning, she was really, she was a bit sick… lethargic… and I was two and a half hours away.

“Justin and the lady who… came to do the auction for her mom, who was her friend, she asked if she could mind while I was going and she grabbed me… I didn't want her to go up in the car… throwing up.

“She was fine with it, and the lady said, 'Don't worry, take as much time as you want,' and when we came back, they were gone, and I thought maybe they had taken her. .so I called the hospitals, but nup.”

He said he had been “looking for it in the woods and everything, that's why it's been two days.”

The operator asked her if she had “any idea where she [Charlise] she could have left,” and said her daughter was “here on vacation for a month.”

Detective Sergeant Bradley Gardiner said, according to phone records, Stein texted Kallista Mutten at 8.20pm on January 11, saying: “Hey bub sorry I left my phone in the car, I've been looking for it inside,” which was “Cooking some chicken,” and “Charsey” was watching TV and playing with balloons.

At 10.06am on January 12, Stein allegedly sent another message to his partner, which read: “I'm literally about to walk out the door. Charsey's staying in bed. She's wrecked and she's back to sleep,” then left at 10:13 a.m. By that time, Charlise was supposedly dead.

The prosecutor said Stein was medicated for schizophrenia with quetiapine, which can cause nausea and vomiting, and that Charlise's subsequent toxicology test found the drug in her system. He said the jury could infer that Stein gave the drug to Charlise “by design or … by accident.”

Defense barrister Carolyn Davenport, SC, argues that Stein told several stories “to protect Kallista”.

The jury has heard that Stein and Kallista Mutten met while serving prison sentences and had a history of drug involvement. Charlise lived with her grandparents in Tweed Heads and had been visiting the couple during the school holidays.

The trial continues before Judge Helen Wilson.
